Privacy Policy

Last updated

This policy explains how Berdee Learning ("Berdee", "we", "us") handles information about educators and publishers who use Berdee: the lesson studio, classes, the marketplace, and our AI features. Students have their own policy, the Student Privacy Policy, and visitors without an account are covered by the Website Privacy Notice.

In short

  • We collect what we need to run your account, your lessons, your billing and your sales.
  • When you use an AI feature, what you type and the lesson content involved go to an AI provider. Your students' answers never do.
  • We use product analytics, and record sessions in the lesson studio, to improve Berdee.
  • We do not sell personal information or show ads.
  • You can ask us to close your account at any time. Here is what that does.

What we collect

  • Account details: your name and email address, and the kind of educator you told us you are. You sign in with a link we email you; we have no passwords.
  • Your content: the lessons you build, the images, audio recordings and other files you upload, and the earlier saved versions of each lesson that power its History.
  • Your classes and students: the classes you create and the students you add. What we hold about students, and why, is in the Student Privacy Policy.
  • What you type to our AI features: your requests to the Berdee Assistant and Ask Berdee, image and narration prompts, reference photos you upload for image generation, and the conversation history of those chats.
  • Billing: your plan, invoices, credit balance and purchases, and the billing address used to calculate sales tax. Card details are entered on Stripe's pages and held by Stripe; we never see your full card number.
  • Publishing: your publisher name, bio and picture, your listings, and your sales and payouts. Stripe collects the identity and bank details needed to pay you; we do not hold them.
  • Google Classroom (only if you connect it): your Google account ID and email, and the access Google grants us, which we store encrypted. We can only read your course list and rosters; we never change anything in Google Classroom.
  • AI assistant connections (only if you connect one): which assistant you approved and the access it holds.
  • Messages and feedback: what you send us, and ratings you leave on help articles and tutorials.
  • How you use Berdee: see Analytics and session recording.

How we use it

  • To run Berdee: save your lessons, play them for your students, and show you results.
  • To provide AI features when you ask for them, and keep their cost within your plan.
  • To bill you, pay publishers, and calculate and remit sales tax.
  • To email you: sign-in links, receipts, and notices about your account, plan, purchases or sales.
  • To keep Berdee secure, prevent fraud and abuse, and review reported content.
  • To understand and improve the product, using the analytics described below.
  • To meet legal obligations, such as tax and financial record-keeping.

AI features

When you build a lesson with the Berdee Assistant, chat with Ask Berdee, generate an image, or generate narration or sound effects, we send what you typed and the lesson content involved to an AI provider, and store the result.

  • Language and image models are reached through OpenRouter, which passes each request to the company that runs the chosen model. Narration and sound effects come from ElevenLabs. Some search and checking steps run on Cloudflare's AI services.
  • We also send each AI request and response to PostHog so we can measure cost, speed and quality.
  • We never send your students' answers, or anything taken automatically from student records, in an AI request. But anything you type goes as written: if you type a student's name into a prompt, it reaches the AI provider and PostHog. Please don't.
  • Berdee does not use your lessons or prompts to train AI models. The AI providers that process your requests have their own data terms, which apply to what they receive.

If you connect your own AI assistant to Berdee, it can read and edit your lessons and media, but not your students' names, answers or grades. What it does with your lessons once it reads them is governed by that assistant's own privacy policy.

Analytics and session recording

We use PostHog, through our own domain, to see which features educators use and where they get stuck. Inside your account, PostHog identifies you by account ID, name and email. Studio events record what kind of change you made (for example, "resized a widget"), not the content of your lesson.

In the lesson studio we also record sessions: what was on the screen, mouse movement, clicks and scrolling. Text you type into form fields is masked, but the lesson canvas is recorded as it looks, including any photo you placed in a lesson. We do not record your class lists, grades, billing or settings pages, or any student page.

A sign-in cookie keeps you signed in, and browser storage remembers preferences such as which studio panel was open. The cookies we use on the public site are listed in the Website Privacy Notice.

Turning analytics off

You can turn off product analytics, including studio session recording, for your whole account in Settings › Privacy. That applies on every device you sign in on, and also stops the account events our servers send to PostHog. You can also use the "Do not track me" switch in the footer of our public pages, which applies to that browser, and we treat a Global Privacy Control or Do Not Track signal from your browser as an opt-out automatically. Opting out doesn't affect the cookies Berdee needs to work, such as sign-in, or the records we keep to run the service, such as billing records, security logs and error reports.

Opting out applies from that moment on. Assistant conversations you started before opting out keep your account ID, and session recordings already uploaded before you opted out are not deleted; email support@berdee.app if you want them removed.

Emails we send

Account, billing and marketplace emails (sign-in links, receipts, payment problems, sales and payout notices) are part of the service. You can turn off the optional ones, such as "a lesson you bought has a new version", in Settings or from the link at the bottom of the email.

Who we share information with

We share personal information only with the service providers ("subprocessors") that run parts of Berdee for us, only for that purpose:

  • Cloudflare: hosting, file storage, sending email (including student invitations), logs kept for about a week, AI search, rendering and checking services, and automatic safety checks on uploaded images. Sees all traffic.
  • PlanetScale: our main database, in the United States. Holds everything described in our privacy documents.
  • Stripe: payments, publisher payouts and identity checks, and sales tax.
  • OpenRouter, the model providers it routes to, and ElevenLabs: AI features, as described above. Educators' prompts and lesson content. We never send students' answers or anything taken automatically from student records; whatever an educator types into a prompt, including a student's name, is sent as written.
  • PostHog (United States): product analytics, session recording on marketing pages and in the studio, AI request records, and billing records copied from Stripe (your email, billing address and invoices). No student data.
  • Sentry: error reports, so we can fix crashes. Reports from our servers identify a signed-in educator or admin by account ID, name and email; a signed-in student only by account ID, with the details of the web request removed. Reports from the browser carry no user or request details at all.
  • Google: Google Classroom, if you connect it; Google Fonts, loaded on every page, which sees visitors' IP addresses; and YouTube, for videos you place in a lesson.
  • Vecteezy, Pexels and Pixabay: stock image search in the studio. They receive search terms, not personal information.

Other people see your information only where you choose it: buyers see your publisher profile and listings, and educators you share a lesson with see that lesson.

We don't sell your information

We do not sell personal information, share it for cross-context behavioral advertising, or show ads in Berdee. We have no advertising partners.

How long we keep information

  • Account information: while your account is open. Closing it removes your name and email (see Your choices and rights).
  • Lessons, uploaded files, class names and AI assistant conversations: kept after you close your account, without your name, until you ask us to delete them.
  • Lesson History: every save for 24 hours, then fewer save points the older they get, down to one a day after a year, kept while the lesson exists and your account is open. Versions of a lesson that were assigned to students or sold are kept for good: they are the record of what a student was graded on and what a buyer bought.
  • Server logs: about a week with our hosting provider. Our servers also send their log lines to Sentry, tagged with your account ID, name and email when you're signed in; those are kept as long as Sentry keeps them.
  • Financial records (purchases, sales, payouts, tax): as long as the law requires, even after an account is closed.

Student information follows the Student Privacy Policy.

Your choices and rights

  • You can see and change your lessons, classes and students in Berdee, and change your name and email preferences in Settings.
  • You can disconnect Google Classroom or a connected AI assistant at any time.
  • To get a copy of your information, correct it, or close your account, email support@berdee.app.

Closing an account:

  • cancels your paid plan, if you have one, so you aren't charged again;
  • removes your name and email from the account, and your name, bio and photo from your publisher profile;
  • signs you out everywhere, disconnects any AI assistant you connected (such as ChatGPT or Claude), and disconnects Google Classroom (revoking our access at Google);
  • deletes the students only you teach, with their answers and scores. A student who also has another Berdee teacher stays with that teacher, without your classes, assignments or their work on them (see the Student Privacy Policy);
  • unlists your marketplace listings, so buyers' students can no longer open those lessons;
  • deletes your lessons' History, your AI lesson plans and AI lesson-build records;
  • asks PostHog, our analytics provider, to delete your analytics profile with its events and session recordings.

It does not delete your lessons, uploaded files, class names or AI assistant conversations. We keep them without your name, so a lesson another educator added with your share code keeps working for their students. We don't edit what's inside a lesson, so remove anything personal, such as your name on a title scene, before you close your account. To have them deleted too, email support@berdee.app from your account's email address before you close it, or say so in your closure request. We keep financial records as the law requires.

If you have unspent credits you paid for, ask for a refund before you close your account; the Terms explain which credits qualify.

US state privacy rights

Depending on where you live, state law (for example in California) may give you the right to know what personal information we collect and how we use and share it, to get a copy, to correct it, to delete it, and to opt out of its sale or sharing for targeted advertising. We do not sell or share personal information for advertising, and we treat a Global Privacy Control signal as an opt-out of analytics automatically. To use any of these rights, email support@berdee.app. We will confirm your identity first, for example by replying to the email address on your account, and we will not treat you differently for asking.

Security

All traffic to Berdee is encrypted with HTTPS. Educators and students see only what their role allows, and our staff's sensitive actions in the admin console (such as closing an account or erasing a student) are recorded in an audit log. Google Classroom access is stored encrypted. Repeated failed access-code sign-ins are rate-limited. More detail is on our security page.

No system is perfectly secure. If a breach affects your information, we will tell you as the law requires.

Where information is stored

Berdee is run from the United States. Our main database is in the United States, and our hosting runs on Cloudflare's global network. If you use Berdee from outside the United States, your information is transferred to and processed in the United States. Berdee is built for educators in the United States: prices are in US dollars, and buying marketplace lessons needs a US billing address.

Children

Educator accounts are for adults. Children use Berdee only as students an educator adds, under the Student Privacy Policy. If you believe a child has created an educator account, email support@berdee.app and we will remove it.

Changes to this policy

When we change this policy, we update the date at the top. If a change is significant, we will tell you by email or in Berdee before it takes effect.
